Terms of Service

1. Acceptance of Terms

By accessing or using the Kubikel platform (the "Service"), you agree to these Terms of Service. If you use the Service on behalf of an organization or agency, you represent that you are authorized to bind that organization to these Terms.

2. Definitions

• "Kubikel", "we" refers to Kubikel as the provider of the Service.
• "User", "you" refers to the individual or organization using the Service.
• "Your Content" refers to the data, files, and information you upload to or generate through the Service.

3. The Service

Kubikel is a platform for collecting, structuring, analyzing, presenting, and sharing spatial data, together with the supporting apps within it. We may add, change, or discontinue features from time to time.

4. Accounts and Registration

Some features require an account. You are responsible for keeping your credentials confidential and for all activity on your account. Notify us of any unauthorized use.

5. Plans and Payment

The Service is available with a free trial offering full access for a limited period, and paid subscriptions with full access. Fees, scope, and terms of paid subscriptions are agreed separately. Unless stated otherwise, fees already paid are non-refundable.

6. Permitted Use

You may only use the Service in accordance with applicable law and these Terms, and only for data that you own the rights to or are authorized to process.

7. Prohibited Conduct

You must not:

• use the Service for any unlawful purpose or to infringe the rights of others;
• upload data without a valid legal basis or authorization;
• disrupt, damage, or attempt to access the Service without authorization;
• reverse engineer or misuse the interfaces and API beyond the official documentation.

8. Your Data and Content

Your Content remains yours. You grant us a limited license to process, store, and display Your Content solely to operate the Service. You are responsible for the legality, accuracy, and lawful basis for processing Your Content, including any personal data within it.

9. Intellectual Property

The Service, including its software, design, and brand, is owned by Kubikel and protected by law. These Terms do not transfer any intellectual property rights in the Service to you.

10. Third-Party Services

The Service may connect with third-party data sources or services (for example, government portals or map providers). Use of third-party services is subject to those parties' own terms, and we are not responsible for them.

11. A Tool, Not an Authority

Kubikel is a data-processing tool and not an official authority. The Service's output, including analysis or automated checks, is advisory and must be reviewed and approved by an authorized person before being used for official decisions. Authority over codes, standards, and official decisions remains with the relevant agencies.

12. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind, whether express or implied, including warranties of fitness for a particular purpose, to the extent permitted by law.

13. Limitation of Liability

To the extent permitted by law, Kubikel is not liable for any indirect, incidental, or consequential damages arising from use of the Service. Our total liability is limited as agreed in the applicable paid subscription.

14. Suspension and Termination

We may suspend or terminate access in the event of a breach of these Terms. You may stop using the Service at any time. After termination, you may request an export of Your Content within a reasonable period.

15. Changes to the Terms

We may update these Terms from time to time. We will notify you of material changes through the Service. Continued use after changes means you accept the updated Terms.

16. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of Indonesia. Any dispute will first be resolved amicably, and failing that, through a mechanism agreed by the parties.
